Terms and Conditions

These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and Cabo Visual, S.A. de C.V. ("Cabo Visual," "Company," "we," "us," or "our"), governing your use of our website and engagement of our event production services.
By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with these terms, you must not use our website or engage our services.
1. Services
1.1 Scope of Services
Cabo Visual provides professional event production services, including but not limited to:
- DJ and musical entertainment services
- Professional audio and sound systems
- Lighting design and installation
- Stage construction and rigging
- Dance floor installation
- Hindu wedding specialty services
- Complete event production and coordination
1.2 Service Agreements
All services shall be governed by a separate Service Agreement or Contract that specifies the scope, pricing, timeline, and specific terms applicable to each engagement. In the event of any conflict between this Agreement and a Service Agreement, the terms of the Service Agreement shall prevail.
2. Booking and Reservations
2.1 Reservation Process
To secure our services, clients must:
- Submit a complete booking request with event details
- Receive and approve a written quote or proposal
- Execute a Service Agreement
- Pay the required deposit as specified in the Service Agreement
2.2 Deposit Requirements
A non-refundable deposit, typically ranging from 30% to 50% of the total service fee, is required to confirm a reservation. The specific deposit amount shall be set forth in the applicable Service Agreement. The remaining balance is due according to the payment schedule specified therein.
2.3 Confirmation
A booking is not considered confirmed until (i) the Service Agreement has been executed by both parties, and (ii) the required deposit has been received and processed.
3. Payment Terms
3.1 Pricing
All prices are quoted in the currency specified in the proposal or Service Agreement. Prices are subject to applicable taxes as required by Mexican law.
3.2 Payment Methods
We accept the following payment methods:
- Bank wire transfer
- Credit and debit cards (subject to processing fees)
- Cash (Mexican Pesos or US Dollars)
- Other methods as agreed upon in writing
3.3 Late Payments
Payments not received by the due date may be subject to late fees of 2% per month on the outstanding balance. Failure to make timely payments may result in suspension or cancellation of services.
4. Cancellations and Refunds
4.1 Client Cancellation
In the event the Client wishes to cancel a confirmed reservation:
- More than 90 days before event: Deposit may be applied to a future booking within 12 months, subject to availability.
- 60-90 days before event: 50% of total contract value is due.
- 30-60 days before event: 75% of total contract value is due.
- Less than 30 days before event: 100% of total contract value is due.
4.2 Company Cancellation
In the rare event that Cabo Visual must cancel a confirmed engagement due to circumstances beyond our reasonable control, we will provide a full refund of all amounts paid or offer to reschedule the services at a mutually agreeable date.
4.3 Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations due to causes beyond their reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, civil unrest, government restrictions, pandemics, or other similar circumstances.
5. Client Responsibilities
5.1 Venue Access
The Client shall ensure adequate access to the venue for equipment delivery, setup, and removal at the times specified in the Service Agreement. Any delays caused by inadequate access may result in additional charges.
5.2 Accurate Information
The Client is responsible for providing accurate and complete information regarding the event, venue specifications, and any other requirements necessary for the proper delivery of services.
5.3 Permits and Licenses
Unless otherwise specified, the Client is responsible for obtaining all necessary permits, licenses, and authorizations required for the event.
6. Limitation of Liability
6.1 Maximum Liability
To the maximum extent permitted by applicable law, Cabo Visual's total liability arising out of or in connection with the services provided shall not exceed the total amount paid by the Client for such services.
6.2 Exclusion of Damages
In no event shall Cabo Visual be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities, regardless of whether such damages were foreseeable or whether Cabo Visual was advised of the possibility of such damages.
6.3 Third-Party Claims
The Client agrees to indemnify and hold harmless Cabo Visual, its officers, employees, and agents from and against any claims, damages, losses, or expenses arising from or relating to the Client's event, except to the extent caused by Cabo Visual's gross negligence or willful misconduct.
7. Intellectual Property
7.1 Photography and Videography Rights
Unless otherwise agreed in writing, Cabo Visual reserves the right to photograph and record events for promotional purposes. The Client may request restrictions on such use in the Service Agreement.
7.2 Company Materials
All designs, proposals, quotes, and other materials provided by Cabo Visual remain the intellectual property of Cabo Visual and may not be reproduced, distributed, or used for any purpose other than evaluating our services without prior written consent.
8. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the engagement. This obligation shall survive the termination of this Agreement.
9. Governing Law and Dispute Resolution
9.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of laws principles.
9.2 Dispute Resolution
Any dispute arising out of or relating to this Agreement shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit to the exclusive jurisdiction of the courts located in Cabo San Lucas, Baja California Sur, Mexico.
10. Modifications
Cabo Visual reserves the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting on our website. It is your responsibility to review these Terms and Conditions periodically. Your continued use of our services following any modifications constitutes acceptance of the revised terms.
11. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
12. Entire Agreement
This Agreement, together with any applicable Service Agreement, constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, and understandings, whether written or oral.
